What are the benefits of divorce mediation?

A court proceeding is not the only way to resolve a divorce. Many couples in New Jersey opt for mediation, which encourages collaboration between the two parties to develop a solution to issues such as property division or child custody. According to Top Counseling Schools, mediation will produce a satisfactory agreement in as many as 80 percent of divorce cases.

In addition to finding resolution, there are a number of other benefits to opting for a mediation. Chiefly, many couples find that it is more affordable because it eliminates the cost of drafting motion papers, making court appearances and dragging out proceedings. The American Bar Association reports that the cost of mediating a divorce is up to 40 to 60 percent lower than litigation.

The ABA notes that choosing mediation is also beneficial due to the following:

  • Children benefit from a method that is less stressful than litigation.
  • The mediator has the flexibility to tailor an agreement to the couple.
  • Both parties are able to express their desires.

It is possible that couples will only be able to agree on certain items during mediation and have to take other matters to court. This still amounts to less time in the courtroom and less expense.

The ABA points out that not every couple will be well-suited for mediation. People who wish to take this route should have a respectful relationship and be able to discuss potentially sensitive subjects. Even complex cases may be handled in mediation, but only if both parties can approach the issues respectfully.
